A. Conformity With Budget

Transfer of funds into, within and out of an approved category is permitted up to 20 percent of the approved category amount. Requests for revisions exceeding 20 percent should be received three months prior to the termination date of the grant. Such transfers may not include travel budget. Any purchase of permanent equipment not authorized in the original budget must have prior approval.

The APMRF reserves the right to a refund, on demand, of all grant funds that have been expended in unauthorized ways. The grantee institution is responsible for any unauthorized or excessive expenditures made.

B. Financial Accounting Of Grant

The grantee institution is required to submit to the APMRF a detailed accounting report of expenditures 30 days after the termination date of the grant. In cases in which financial commitments have not been satisfied at the termination date of the grant, the grantee institution is given 90 days to liquidate these commitments. All unexpended funds must be returned to the APMRF along with the final accounting report. Funds may not be carried forward to the continuation or renewal of the grant unless approved by the APMRF.

Payments to the institution for the ensuing year's grant will be contingent on receipt of the initial year's final accounting report and refund as applicable.

The APMRF reserves the right to audit the institution's financial records pertaining to the grant.

C. Payment

Payments to the grantee institution are made semi-annually beginning with the beginning date of the grant.

D. Progress Reports

Funded investigators are often asked to present their findings at the annual Scientific Conference on Niemann-Pick Type C Disease.

E. Transfer Of Grant

On written request, transfer of a grant to another institution will be considered by the APMRF provided we are alerted by the Principal Investigator in sufficient time prior to the anticipated move.

F. Extension Of Grant Period

An extension of the termination date of a grant will be considered by the APMRF on written request by the Principal Investigator if there are funds remaining and the project is still viable.  An extension must be requested at least three months prior to the termination date of the grant.

G. Responsibilities Of Principal Investigator

If the Principal Investigator is unable to complete the research approved because of illness, departure from the institution, or other major cause, this matter must be brought immediately to the attention of the Executive Director.

H. Personnel

Personnel compensated in whole or in part with funds from a grant of the APMRF shall not be considered employees or agents of the APMRF.

I. Patents And Discoveries Under Grant

All inventions made with the support in whole or in part by this grant must be reported at the earliest practical time to the APMRF.

The APMRF strongly encourages publication of any significant research results. Each grantee shall furnish the APMRF with one reprint or other copy of any published report of such research. Any such publication should carry a credit line reading, "supported in part by a research grant from the Ara Parseghian Medical Research Foundation."

In addition to the grant award/contract letter that is mailed to PI's who are being awarded a new grant from the APMRF, an Intellectual Property Rights Agreement is also included.  The award/contract letter and the IP Agreement must be signed by the PI's institution before funding is granted.  The APMRF's IP Agreement, in part, states the following:

Grantee authorizes APMRF to diligently undertake all responsibilities and obligations in connection with marketing and licensing the Proprietary Property and/or Patent Rights to third parties for applications to NPC disease, including negotiation and execution of licensing agreements on terms and conditions as APMRF deems necessary to appropriately make the benefits of the Proprietary Property available to the public. In exchange for such authorization, APMRF will transfer half of any royalties or other revenues (net out-of-pocket expenses) derived from such licenses. While APMRF is administering Grantee's interest in Proprietary Property pursuant to this Agreement, APMRF shall provide Grantee copies of all licenses issued thereon.

Grantee may retain all rights in any inventions or discoveries made under this grant that do not relate to the diagnosis or therapy of NP-C (for example, a new genetic sequencing technique). Grantee hereby agrees to pay to the APMRF 10 percent of any royalties or other revenues generated by the license or other transfer of any such invention or discovery, which the APMRF would intend to reinvest in its Research Program.

J. Ownership Of Purchased Materials

All apparatus and materials purchased and all scientific equipment and instruments paid for with grant funds of the APMRF shall be the property of the grant institution.

K. Publicity On Work Under Grant

The grantee institution will cooperate with the APMRF in announcement through the news media of grants awarded subject to the Principal Investigator's approval of the content of any news release prepared by the APMRF.

The grantee institution, the Principal Investigator and personnel working under the grant will cooperate fully with the APMRF in the written, photographic, filmed, broadcast or other forms of materials prepared to publicize work under the grant.
